1. About this policy

Distributions Elka Beauté Inc. (“Elka Beauté”, “we”, “us”) respects your privacy and is committed to protecting the personal information you entrust to us. This policy explains what personal information we collect through elkabeaute.com, why we collect it, who we share it with, how long we keep it, and the rights you have. It is provided under Québec’s Act respecting the protection of personal information in the private sector (as modernized by Law 25).

Personal information is any information that relates to a natural person and allows that person to be identified, directly or indirectly.

3. What personal information we collect and why

We collect personal information only when you choose to provide it, for the purposes described below.

Newsletter sign-up

  • Collected: email address.
  • Purpose: to send you newsletters, promotions, and marketing communications, with your consent.

Pro Membership application

  • Collected: name, email, phone, website, address (street, city, state/province, postal code, country), and uploaded documents you provide to prove professional status (a photo ID plus one professional credential, such as a cosmetology or esthetician license, a professional diploma/certificate, a letter of employment, a business card or professional website, a student ID, or proof of enrollment).
  • Purpose: to verify your professional or student status in the beauty industry, and to create and manage your professional account (including any professional pricing).
  • Note: the documents you upload are used only to confirm your eligibility. We delete them once verification is complete — see Section 8.

Contact form

  • Collected: name, email, message, and phone (optional).
  • Purpose: to respond to your question or request.

Checkout / orders

  • Collected: billing and shipping details (name, address, email, phone), order details, payment information (processed by our payment provider — see Section 6), and date of birth (optional).
  • Purpose: to process and deliver your order, handle returns and customer service, and meet our legal and accounting obligations.
  • Date of birth (optional): used only to send you birthday offers. If you prefer not to provide it, you can still complete your purchase.

4. Consent

We collect, use, and share your personal information with your consent, or as otherwise permitted by law. Your consent is requested at the point where the information is collected, for the specific purpose described.

  • For marketing communications (newsletter, promotional emails), we ask for your express, opt-in consent, and you can withdraw it at any time.
  • You may refuse or withdraw your consent to optional collection without affecting your ability to purchase from us, except where the information is necessary to provide the product or service you requested.

5. Who we share your information with

We do not sell your personal information. We share it only with service providers who help us operate, and only to the extent needed for them to perform their service on our behalf:

  • SiteGround — website hosting (servers located in the United States; see Section 7).
  • Canada Post — order delivery.
  • PayPal and Bambora — to process payments securely. We do not store your full payment card details.
  • Mailchimp — to send newsletters and marketing emails.
  • Meta Platforms (Facebook/Instagram) — advertising and measurement (see our Cookie Policy).
  • Google (Google Ads and Google Analytics / GA4) — advertising and website analytics (see our Cookie Policy).

We may also disclose personal information where required by law.

6. Payment

Payments are processed by our third-party payment providers, PayPal and Bambora. Your payment card information is handled directly by these providers under their own security standards; we do not retain your full card number.

7. Storage and processing outside Québec

Some of our service providers store or process personal information outside Québec, including in the United States (for example, our hosting provider’s servers are located in Iowa, and Meta and Google process certain data in the United States). Before transferring personal information outside Québec, we assess the transfer to confirm the information will receive protection that is adequate under Québec law, including through contractual safeguards with our providers. By providing your information, you understand it may be stored or processed outside Québec.

8. How long we keep your information

We keep personal information only for as long as necessary to fulfil the purposes for which it was collected, and then securely destroy or anonymize it. Our retention periods are:

9. How we protect your information

We use reasonable physical, technical, and organizational security measures to protect your personal information against loss, theft, and unauthorized access, use, or disclosure. Access to personal information is limited to people who need it to perform their duties.

10. Your rights

Under Québec law, you have the right to:

  • Access the personal information we hold about you;
  • Correct information that is inaccurate, incomplete, or out of date;
  • Withdraw your consent to the use of your information (for example, unsubscribe from marketing);
  • Request deletion or de-indexing of your information in certain circumstances;
  • Data portability — receive the computerized personal information you provided to us in a structured, commonly used technological format.

11. How to exercise your rights or make a complaint

To exercise any of these rights, or if you have questions or concerns, contact our Privacy Officer (Section 2). We will respond within the timeframe required by law (generally 30 days).

12. Minors

Our website and products are intended for adults. If we knowingly collect personal information from a minor under 14, we will obtain consent from the person having parental authority, as required by Québec law.
